DeepSleep processes your data to help you improve your health while maintaining the security of your data.
As the data controller, DeepSleep is committed to giving the highest level of attention to your privacy and protection.

Our privacy policy explains in detail how we will process your personal data when you use our products and services. These products and services include various software applications (such as mobile and web apps, device firmware, cloud services) and connected products that collect, store and process data to provide insights and services to help you live a healthier life (the “products” and “services”).

What information?
Depending on the product you use, how you use it, or how you obtain it, DeepSleep may collect some of the following data:

Identity data: data that can directly identify you, such as your email address, date of birth, username, name, phone number, and postal address.

Activity data: varies by product. Activity data refers to measurements of your physical activity, mainly your sleeping data.

Physiological or health data: data derived from measurements of your bodily functions and physical activity. Depending on the product you use, this may include your heart rate, heart sounds, sleep cycles, and snoring events and so on.

Environmental data: data related to your environment or surroundings, for example the noise level, and so on.

Technical data necessary for the use of products and services: such as Wi-Fi network information, technical logs, product activation date, battery measurement data, serial numbers, debugging technical information and website cookies.

When you purchase a product on our website, we process your banking details. We use this information only for verification purposes and do not store it.

When do we collect this information?

When you create a DeepSleep account, you provide certain personal data. Your DeepSleep account is central to the products and services so that you can access and control your personal data.

When you use our applications, some personal data is recorded in your DeepSleep account. This happens when you set alarms, share information, measure steps, fill in fields in the app, install and sync devices and apps, and enable optional features such as location services on your phone. All personal data we collect while you use the app is stored in your DeepSleep account.

When you use our products and services, we collect your personal data to help you monitor your health. Each product requires collection and processing of specific personal data. For example, our scales collect your weight or fat mass data, whereas our blood pressure monitors do not collect such data.

When you choose to share DeepSleep data with other applications, we exchange data with partners via an API (application programming interface). You can log into your DeepSleep account at any time and manage sharing preferences or stop data sharing.

When you contact our customer support team, our team may temporarily access some personal data in your DeepSleep account until the issue is resolved.

How do we use your personal data?
Data collected through DeepSleep products and services is processed by DeepSleep for the specific purposes set out below. Data may be used for multiple purposes simultaneously.

To provide products and services. Personal data processed by DeepSleep is stored in your DeepSleep account and accessible in the application. Personal data may appear as raw data (steps, weight, etc.) or as results of specific data processing (heart rate, breathing, movements indicating sleep patterns, etc.).

To communicate with you. When you contact our customer support to resolve an issue you reported, our team members may need to process your personal data in order to help you. Unless you consent otherwise, they will not be able to view personal health data you have specifically designated, such as your weight or blood pressure.

To improve our products and services. We may use your anonymized personal data to improve our products, services and customer support. We may need to process certain data to correct or modify software settings.

Marketing, advertising and recommendations. Your personal data may be used to provide you with surveys, contests, discount coupons or promotional activities you can participate in. We may provide you with information about our products, such as new features, promotions from DeepSleep or our partners, or announcements of new products. The legal basis for these purposes is your consent to this privacy policy, which we will seek when you create an account. In addition, your health data may be anonymized (so it cannot be identified or linked to an account) and used by the DeepSleep Health Institute team as raw data for research and analysis in the field of health to advance scientific research.

How do our products work and how do they process your personal data?
All DeepSleep products are connected objects that require the use of an iOS or Android device. Therefore, creating a DeepSleep account via a device is a prerequisite to installing the product.

Our products work via wireless connections (Wi-Fi, Bluetooth, 3G/4G) to support product configuration and to transfer and sync the data collected with your DeepSleep account. Some features only work after connecting the product to the app. When you sync a product with the mobile app, or connect the product to a Wi-Fi network, the personal data collected by the product is stored and transmitted to the servers in your DeepSleep account. Synchronization to our servers is necessary in order to:

detect product anomalies through remote diagnostics provided as part of customer service;

update device software to fix bugs, add new features or implement changes necessary due to legal and regulatory developments in the data field;

backup data: if the iOS or Android device on which the app is installed is lost or stolen, you can restore all data;

take measurements without having to be close to the device on which the app is installed;

share your data across multiple devices: you can access the latest measurements through your DeepSleep personal account and any device with the app installed.

Do we share your personal data?
Your personal data will not be distributed, conveyed, exchanged or transferred to third parties by any medium. Only in the hypothetical case that DeepSleep and its assets were to be acquired would we transfer your data to a potential purchaser, and that purchaser would be required to assume the same obligations to protect your data. To ensure a high quality experience, we may disclose certain data in strictly defined cases to DeepSleep subsidiaries and authorized third parties. We may convey your data to DeepSleep affiliates and authorized third parties that comply with the GDPR and this privacy policy—for example to deliver products you purchased, provide customer support, or verify banking data.

International transfers of personal data. We provide services through hosting providers located in France. Therefore, your data may be transferred to regions outside the country in which you use our services, including countries outside the European Economic Area (EEA) that may not have specific data protection laws. In such cases we will ensure that such transfers have a legal basis, that your data is adequately protected, that contracts approved by the competent authorities are in place and that additional data protection measures are required.

Mandatory disclosure. The law may require us to disclose your personal data to certain authorities or other third parties, such as law enforcement or judicial authorities.

How do we protect your personal data?
We make every effort to ensure the security of your personal data.

How do we ensure respect for children’s privacy? Withings’ products and services are intended for the general public.

How do we ensure the quality of your data? We recommend that you log into your Withings account regularly and confirm that your personal data is accurate and up to date. If you have any doubts about data accuracy, please inform us and we will take measures to correct or delete inaccurate data.

What measures do we take to protect your personal data? Protecting your privacy and security is essential to how we design and deliver products and services. We apply our policies through carefully chosen appropriate activities (such as proactive risk management and privacy guidance). We take appropriate measures to ensure online security and personal safety and to eliminate the risk of data loss. Only employees with a legitimate reason to access this information have access to our databases.

How do we use cookies and web beacons? DeepSleep uses cookies, web beacons and other similar technologies to operate and improve our website. What rights do you have?You may opt out of marketing communications and request that we stop using your data for marketing purposes. We may still send   you security-critical alerts. You also have the right to access, correct and delete your personal data.

Changes to this policy. DeepSleep may modify the current policy, block access to the website, or change its access conditions with or without prior notice. However, if the policy is to be substantially changed, DeepSleep will post a notice on this page and its header to provide a 30-day notice to web users. We recommend that you visit the policy regularly to stay informed of any changes.

How long do we retain your personal data?
To make it easier for you to use our products and services, we will retain your data until you request its deletion.

If you request deletion of your data, all your data will be permanently deleted within 30 days of your request.

However, if you have deleted your DeepSleep account and later wish to use our products and services again, simply create a new account.
